New Yorkers Back the Film & TV Production Tax Credit

Since its introduction in 2004, the New York State Film and Television Production Incentive has fueled the growth of the industry, generating billions in economic activity and creating over a million union jobs. This program has transformed film and TV production into a multi-billion-dollar sector in New York.

The industry not only provides well-paying, high-quality jobs but also benefits local businesses, contributing an average of $1.3 million to the local economy for each day a production is underway.

It’s no surprise that a recent survey found 78% of New Yorkers in favor of the tax incentive, with strong bipartisan support—86% among Democrats, 68% among Independents, and 72% among Republicans. Voters understand the importance of keeping productions in New York, with 62% highlighting increased tax revenues and business investments as primary reasons for supporting the program.

FY2026 Budget: What’s Changing?

Governor Kathy Hochul has introduced updates to the New York State Film Production Tax Credit as part of the FY2026 budget, aiming to enhance the state’s competitive edge, sustain long-term industry growth, and ensure a stable workforce. Key improvements include:

  • Production Plus Program: Additional tax credits for large-scale productions with at least $100 million in qualified spending, as well as independent projects exceeding $20 million.

  • Independent Film Support: A dedicated $100 million funding pool for independent films.

  • Extended Program Duration: The tax credit is extended by two years, now running through 2036, offering long-term stability for productions.

  • Expanded Coverage for Above-the-Line (ATL) Costs: Increased eligibility for salaries of actors, directors, writers, and producers, while maintaining the overall ATL compensation cap.

  • Faster Credit Processing: Large productions can now claim the full credit within the first year, reducing delays and benefiting both studio-backed and independent projects.

  • Workforce Development Investment: An annual $3.5 million allocation to workforce development programs, fostering diverse job opportunities for New Yorkers.
